Changes to Road Closures, Area Closures, and Evacuations

As of Friday, October 5, 2012, Forest Road 233 (Crooked River Road), Forest Road 421, and Dixie Road (Forest Road 222) are open to the public. The Nez Perce National Forest has also issued a new closure order that makes more land around the McGuire fire open to public use (see the article posted on 10-4-12). The communities of Dixie, Comstock, and Concord have been reduced from a Stage 3 evacuation request to a Stage 2 evacuation warning. No communities are under a Stage 3 evacuation at this time. The following airstrips are open: Dixie, Dixie Guard Station, and Orogrande. The temporary flight restriction remains in place. Also, the Mcgruder Corridor (Forest Road 468) remains closed.

ORDER
Pursuant to Title 36 Code of Federal Regulations (CFR) 261.50(a) the following acts are prohibited on portions of the Red River Ranger District, as described in this order and shown on the attached map, within the Nez Perce Clearwater National Forests. These restrictions are in addition to those general prohibitions in Title 36 CFR, Part 261, Sub-part A, become effective immediately and shall remain in effect until rescinded.
1. Going into or being on National Forest System lands, roads or trails within the defined area below, which are closed for the Public Health and Safety. 36 CFR 261.53(e)
LOCATION
The McGuire Complex Fire area closure is described as follows:
Starting at the junction of Forest Road #222 and Forest Road #1190 (T27N, R9E SE1/4 Sec16), then follow Forest Road #1190 in a southeast direction to its junction with Forest Road #421 (T27N, R9E NE1/4 Sec 21), then follow Forest Road #421 in a southern direction to its junction with Forest Trail #96 (T25N, R9E SW1/4 Sec1), then follow Forest Trail #96 in a southwestern direction to its junction with Forest Trail #210 ( T25N, R9E SW1/4 Sec 1), then follow Forest Trail #210 in a northwestern direction to its junction with Forest Road #222 (T26N, R8E NW1/4 Sec34), then follow Forest Road #222 in a southwestern direction to its junction with Forest Road #311 (T25N, R8E NW Sec8), then follow Forest Road #311 in a western direction to its junction with Forest Road #311A ( T25N, R8E NE1/4 Sec7), then follow forest Road #311A in a southern direction to its junction with Forest Trail #215 (T25N, R8E NW1/4 Sec18), then follow Forest Trail #215 in a western direction to its junction with Forest Trail # 204 (T25N, R7E SE1/4 Sec 10), then follow Forest Trail #204 in a northern direction to its junction with the wilderness boundary (T27N, R7E NW1/4 Sec31), then follow the wilderness boundary in a northeastern direction to its junction with Forest Roads #233 (T27N, R7E NW1/4 Sec32), then follow Forest Road #233 in a northeastern direction to its junction with Forest Road #9836 (aka Forest Trail #821), then follow Forest Road #9836 in a northeastern direction to its junction with Forest Road #1803 ( T28N, R8E NE 33), then follow Forest Road #1803 in a eastern direction to its junction with Forest Trail #8209 (T28N, R8E NE1/4 Sec33 then follow Forest Trail #820 in a eastern direction to its junction with Forest Trail #508 (T28N, R8E NW1/4 Sec 34) then follow Forest Trail #508 in a southern direction to the Center of Section 3, T27N, R8E at the head of Moose Butte drainage, then follow drainage to its junction with Forest Road #9532 (T27N, R8E SW 1/4 Sec2), then follow Forest Road #9532 in a southeastern direction to its junction with Forest Road #1150 (T27N, R8E NW1/4 Sec12) then follow forest Road #1150 in a southeastern direction then in a northeastern direction to its junction with Forest Road #1196 (T27N, R9E SE1/4 Sec8) then follow Forest Road #1195 in a southern direction to its junction with Forest Road #222 (T29N, R9E SE1/4 Sec17 ) then follow Forest Road #222 in a eastern direction to its junction with Forest Road #1190 the point of origin.
EXEMPTIONS
Pursuant to Title 36 CFR 261.50(e), the following persons are exempt:
1. Persons with specific written authorization for the otherwise prohibited act or omission.
2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty. Federal or State administrative personnel in the performance of an official duty.
3. Forest Road #222 will be open for access from its junction Forest Road #1196 to the south side of the town of Dixie, the rest of Forest Road #222 will be open.
4. Forest Road #1190 will be open from its junction with Forest Road #222 to its junction with Forst Road #421
5. Forest Road #421, 311A, 9836, 9532, 1195 and 233 will be open.
6. Forest Trail #96, 210, 215, 204 and 820 will be open
7. Forest Road #311 will be open from its junction with Forest Road #222 to its junction with Forest Road #311A
8. Forest Road #1803 will be open from its junction with forest Road#222 to its junction with Forest Road #9836
9. Forest Trail #508 will be open from its junction with Forest Trail #820 to the Center of Section 3, T27N, R8E.
10. Forest Road #1150 will be open from its junction with Forest Road #9532 to its junction with forest Road #1195.

RATIONALE: These restrictions are promulgated to provide for public safety due to fire activity and falling tree hazard in the McGuire Complex Fire Area.
PENALTY: Violation of this order is prohibited by provisions of the regulations cited, and under USC 551 and 18 USC 3559 and 3571. Any violation is subject to punishment by a fine of not more than $5,000 for and individual or $10,000 for an organization, or imprisonment for not more than six months, or both.
NOTIFICATION: A copy of this order shall be posted in the Forest Supervisor’s Office and each District Ranger’s office and other appropriate locations as prescribed under Title 36 CFR 261.51.
